PRIVATIVOS DE LIBERDADE TRANSGÊNERO: O DILEMA SOB A ÓTICA DOS DIREITOS HUMANOS E JUDICIAL

A Revista Acadêmica Online, com prazer, introduz o estudo intitulado “PRIVATIVOS DE LIBERDADE TRANSGÊNERO: O DILEMA SOB A ÓTICA DOS DIREITOS HUMANOS E JUDICIAL" de lavratura do pesquisador:  Everaldo Antônio de Jesus.

O artigo aborda a complexa questão dos indivíduos transgênero no sistema prisional, analisando-a à luz dos princípios fundamentais dos Direitos Humanos e das questões jurídicas associadas. Por meio de abordagem qualitativa, a pesquisa se dá através de bibliografia de pesquisadores sobre e decisões judiciais sobre a temática e decisões. A discussão envolve a experiência única enfrentada por presos e presas transgênero, destacando desafios relacionados à identidade de gênero, acesso a cuidados de saúde adequados e proteção contra discriminação e violência. Ao longo do texto, são examinadas as lacunas legais e as dificuldades enfrentadas pelos sistemas judiciais ao lidar com a população trans no contexto penitenciário. O artigo destaca, nos resultados, a importância de políticas e práticas prisionais inclusivas, que reconheçam e respeitem a identidade de gênero dos detentos transgênero. Além disso, o artigo conclui destacando a importância da colaboração entre organizações de direitos humanos, especialistas legais e autoridades prisionais para desenvolver abordagens que conciliam os direitos individuais com as complexidades do sistema prisional.

ABSTRACT: 

The article addresses the complex issue of transgender individuals in the prison system, analyzing it in light of the fundamental principles of Human Rights and associated legal issues. Through a qualitative approach, the research relies on literature from scholars and legal decisions on the subject. The discussion revolves around the unique experiences faced by transgender inmates, highlighting challenges related to gender identity, access to appropriate healthcare, and protection against discrimination and violence. Throughout the text, legal gaps and difficulties faced by judicial systems in dealing with the transgender population in the prison context are examined. The article emphasizes, in its findings, the importance of inclusive prison policies and practices that recognize and respect the gender identity of transgender inmates. Furthermore, the article concludes by highlighting the significance of collaboration among human rights organizations, legal experts, and prison authorities to develop approaches that reconcile individual rights with the complexities of the prison system.
