O SISTEMA BRASILEIRO DE PRECEDENTES, OS PRECEDENTES DO SISTEMA COM MON LAW E A (IN)EXISTÊNCIA DE APROXIMAÇÃO ENTRE ELES

A Revista Acadêmica Online, com prazer, introduz o estudo intitulado “O SISTEMA BRASILEIRO DE PRECEDENTES, OS PRECEDENTES DO SISTEMA COM MON LAW E A (IN)EXISTÊNCIA DE APROXIMAÇÃO ENTRE ELES" de lavratura da pesquisadora: Maria Fernanda Vianez de Castro Cavalcanti e Barbosa.

O presente trabalho científico tem como finalidade fazer uma análise acerca do sistema de precedentes e sua aplicação no ordenamento jurídicopátrio. Com efeito, analisar-se-á os dois grandes sistemas jurídicos, quais sejam o common law e o civil law, se examinando os seus contextos históricos e pontuando a aplicação do sistema de precedentes em cada um deles, a fim de compará-los e verificar se existe ou não uma aproximação entre tais. Ademais, far-se-á uma incursão nos dispositivos legais responsáveis pela instituição do sistema de precedentes no Brasil.

Abstract:The present scientific article has the purposeof analyzing the system of precedents and its application in the legal order of the country. Thus, the two major legal systems, common law and civil law, will be analyzed by exploring their historical contexts and emphasizing the application of the precedent system in each of them, in order to compare and to verify if there is a relation between them. Furthermore, an incursion will be made in the legal dispositions responsible for the institution of the system of precedents in Brazil.
