CONTRATO DE FACÇÃO COMO ESTRATÉGIA EMPRESARIAL FUNDADA NA INFORMALIDADE

A Revista Acadêmica Online, com prazer, introduz o estudo intitulado “CONTRATO DE FACÇÃO COMO ESTRATÉGIA EMPRESARIAL FUNDADA NA INFORMALIDADE – UMA ANÁLISE SOBRE O INSTITUTO DA TERCEIRIZAÇÃO NO SETOR DE CONFECÇÃO CEARENSE SOB A ÓTICA DA PROTEÇÃO TRABALHISTA" de lavratura do pesquisador: Cicero Erivelthon Gomes de Melo.

O foco do presente estudo é a análise da relação entre a reorganização da cadeia produtiva da indústria têxtil e de confecção cearense, através do contrato de facção, e o aumento da informalidade nesse importante setor da economia local, especialmente sob a lente da minimização da proteção trabalhista e ofensa a dignidade do trabalhador. A metodologia do estudo se pautará, em um primeiro momento, em revisões bibliográficas de cunho qualitativo, buscando autores que abordem a informalidade e as consequências sociais desse fenômeno. Após, será feita uma análise crítica sobre o papel da justiça trabalhista, materializada em decisões judiciais que tratam sobre a distinção entre facção x terceirização, na garantia da proteção do trabalhador e uma sugestão construtiva com vistas a concretizar o trabalho digno na indústria têxtil e de confecção cearense.

Abstract 

The focus of the present study is the analysis of the relationship between the reorganization of the productive chain of the textile and clothing industry in Ceará, through the faction contract, and the increase of informality in this important sector of the local economy, especially from the perspective of minimizing the protection labor and offense to the dignity of the worker. The study methodology will be based, at first, on qualitative bibliographic reviews, seeking authors who address the informality and social consequences of this phenomenon. Afterwards, a critical analysis will be made of the role of labor justice, materialized in judicial decisions that deal with the distinction between faction x outsourcing, in guaranteeing the protection of the worker and a constructive suggestion with a view to achieving decent work in the textile and textile industry cearense confection.
