A ATUAÇÃO DA ADVOCACIA-GERAL DA UNIÃO NA ARBITRAGEM E PROCESSOS ARBITRAIS

A Revista Acadêmica Online, com prazer, introduz o estudo intitulado “A ATUAÇÃO DA ADVOCACIA-GERAL DA UNIÃO NA ARBITRAGEM E PROCESSOS ARBITRAIS" de lavratura da pesquisadora: Bárbara Cordeiro Figliuolo.

A arbitragem adentrou no ordenamento jurídico brasileiro com a Lei n^o 9.307/1996, ganhou destaque com o Código de Processo Civil de 2015 e, por meio da Lei n^o 13.129/2015, admitiu-se sua utilização no âmbito da Administração Pública. O presente artigo tem como finalidade fazer uma análise da arbitragem sob a perspectiva da Administração Pública, mais precisamente, da União. A arbitragem no âmbito da União exige a presença da Advocacia-Geral da União. Segundo o art. 131 da Constituição Federal, a AGU é a instituição que, diretamente ou através de órgão vinculado, representa a União, judicial e extrajudicialmente. Assim, pretende-se estudar os aspectos gerais da arbitragem como método alternativo de solução de conflitos, perpassando pelas suas características específicas de aplicação para o Poder Público Federal.

ABSTRACT

Arbitration entered the Brazilian legal system with Law number 9.307/1996, gained prominence with the Civil Procedure Code of 2015 and, through Law number 13.129/2015, its use was admitted within the scope of Public Administration. The purpose of this article is to analyze arbitration from the perspective of the Public Administration, more precisely, of the Federal Attorney General. Arbitration within the scope of the Federal Government requires the presence of the Attorney General's Office. According to art. 131 of the Federal Constitution, the Attorney General’s Office is the institution that, directly or through a linked body, represents the Union, judicially and extrajudicially. Thus, it is intended to study the general aspects of arbitration as an alternative method of conflict resolution, going through its specific characteristics of application for the Federal Public Power.
